KYZON Solutions terms and conditions of use
At KYZON Solutions we like to make it simple. We provide a platform for you to hold your meetings and store files. Unless you have a specific agreement in place with us, your use of our platform is governed by these terms and conditions.
The platforms are for you or your business's internal use only. You cannot resell, rebadge or offer to third parties access to the platform as your own offering, unless by specific agreement with our company.
Except for any trial period or other promotion, we charge a monthly fee to use the platform and you can only use the platform if you have paid all outstanding monthly fees. If the monthly fees are not paid, we will suspend your access to our services unless you have reached out to our support at support@kyzonsolutions.com.
We may change our fees at any time. If you are on a fixed term subscription, we will provide you with at least 30 days notice of any change of fees but your existing subscriptions terms will be honoured for the remainder of the contract. You can also terminate the remainder of the contract if you wish by written notice to us within one month of such notice.
If you are on a fixed term subscription, we will roll that subscription over to a new equivalent term when your current subscription term ends, unless you advise us in writing before the current term ends or within one month of that new term commencing that you do not wish to continue to use the service, in which case we will cancel your subscription at the end of the fixed term or the first month thereafter (as applicable).
We will ensure that the platform is hosted on secure servers (such as AWS or equivalent) and will take all reasonable steps to ensure that the platform is available as guaranteed. While we take measures to ensure backup servers are implemented to maximise service availability, we are however not liable if the platforms are unavailable due to third party issues.
We will ensure that the platforms includes all features publicly advertised by us as available on the platforms. Features outside your current plan will be available when you or your company decides to upgrade your existing plan.
You are responsible for the security of all users' accounts created and allocated by you.
We will maintain IT data security protocols consistent with current industry best practices to secure your data. The platform is designed so that if you are an individual, you will be the only person able to access your data and if you are using the platform under an organisation's account, then only authorised users of that organisation will be able to see the organisation's data. We do not however warrant that we can protect against malicious data attacks or other breaches of security by third parties, including without limitation any breach of the security of the server and platforms where the services are hosted and/or where your data may be stored.
If you cease to use our services, we will on request return or delete your data, subject to payment of any outstanding fees.
We do not monitor your use of the platforms or any meetings or the contents of any documents you share or store on the platforms. We do not moderate content. We do not know what purpose (business or other) for which you may use the platform and we do not represent that the platform is suitable for any particular purpose.
We comply with all applicable data protection and privacy laws. We do not use or share your data with others except with your consent, as provided for under those laws.
We will only hold your personal data to the extent required by law or necessary to provide you the services and features of the platform. You may request that we correct or delete any of your personal data by contacting us on privacy@kyzonsolutions.com. You acknowledge and agree that we have no liability for any reduced functionality of quality of service arising from any deletion of any of your personal data.
We do not have any liability for any loss or damages suffered by you or your business if the platform or any of its features are not available. To the extent permissible by law, your only remedy is a refund of your subscription fee for the time the platform was not available to you, unless by specific agreement with our company.
Your continued use of the platform means that you agree to these terms and conditions.
